These Terms and Conditions of Use (hereinafter, “Terms”) regulate access and use of the site infestante.com (hereinafter, the “Website”). By accessing or using the Site, you accept these Terms. If you do not agree to them, please do not use the Site.

2) Scope of application and relationship with other documents

These Terms cover use of the Site and its contents (texts, images, product sheets, blogs, contact forms, account area).

The online shopping carried out on the Site are instead regulated by the General Conditions of Sale (GCS), which regulate prices, availability, ordering, payment, delivery, right of withdrawal, legal guarantee and complaints. The processing of personal data is governed by the Privacy Policy and the use of cookies from Cookie Policy.

3) Access and use of the Site

3.1 Service availability. The Site is provided on an "as is" and "as available" basis. We may suspend, limit, or modify certain features for maintenance or technical/security reasons.
3.2 User Conduct. You agree not to: (a) violate any law or the rights of any third party; (b) upload or transmit malware, malicious scripts, or harmful content; (c) attempt to gain unauthorized access to any area or system of the Site; (d) use the Site in any way that could harm its operation or the experience of any other user.
3.3 Account. Some features (e.g., order history) require the creation of an account. You are responsible for confidentiality of credentials and the activities performed through your account; you must inform us without delay in the event of unauthorized use.
3.4 Eligibility to purchase alcohol. The sale of alcoholic beverages it is forbidden to minors under 18 years of age. Access to the Site is free, but to purchase wine a declaration of majority is required and a document upon collection/delivery.

4.1 Rights. Unless otherwise indicated, all contents of the Site (brands, logos, texts, photographs, graphics, layout) are the property of the Owner or used under license and are protected by the laws on copyright e brands.

We do not control and are not responsible for the content, security, or practices of these third parties.

7) Exclusion of warranties

To the maximum extent permitted by law, the Site and the contents are provided without guarantees express or implied (e.g., fitness for a particular purpose, continuity of service, error-free). We strive to maintain accurate and up-to-date information, but we do not guarantee that the Site will be uninterrupted or error-free.

8) Limitation of liability

Except in cases of intent or gross negligence, the Owner is not liable for: (a) indirect, incidental, consequential damages; (b) loss of profits, revenues or data; (c) inability to access or use the Site; (d) content or services of third parties linked to it. In any case, our aggregate liability to the user shall not exceed the greater of €50 or the amount, if any, paid by the user for specific services on the Site not related to the purchase of products (which remains governed by the GTC).

The user undertakes to to indemnify and hold harmless the Owner from claims by third parties arising from non-compliant use of the Site or violation of these Terms, without prejudice to the legal limits applicable to consumers.

We may update these Terms for legal, technical, or service reasons. Changes will be posted on the Site with an indication of the last updated date; your continued use of the Site after posting constitutes acceptance of the changes.

13) Applicable law and competent court

These Terms are governed by the Italian law. If you are consumer, the court of your place of residence or domicile has jurisdiction. For non-consumer users, the court of your place of residence or domicile has exclusive jurisdiction. Bari Forum.

14) Final clauses

14.1 Partial nullity. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain valid.
14.2 Failure to exercise. Failure to exercise a right does not constitute a waiver.
14.3 Version. The Italian version of the Terms prevails.
